Amount and term limits
For transactions entered on or after the 2026 Act effective date, the total proceeds a customer may receive across all open Kentucky deferred-deposit transactions may not exceed $600. The commissioner must adjust that aggregate ceiling annually by CPI, but may never raise it above $850.
The statutory service fee covers a period of at least 14 days, and a licensee may not agree to hold a deferred-deposit transaction for more than 60 days.
Interest, fees and repayment
The fee is defined as a service fee rather than interest and is calculated from the face amount of the check, not simply from the cash proceeds. Because the customer-proceeds amount and check face amount differ, this page does not present a one-input statutory calculator.
A licensee may charge no more than $15 per $100 of the face amount of the deferred-deposit check, prorated for partial $100 amounts.
The transaction is based on a deferred payment instrument held for the agreed period. Kentucky allows no more than two open deferred-deposit transactions for the same customer at one time.
Rollovers, refinancing and early payment
- Rollover allowed?
- No
A licensee or affiliate may not, for a fee, renew, roll over, or otherwise consolidate a deferred-deposit transaction. - Prepayment penalty allowed?
- Not reduced to a yes/no rule
The primary sources used for this rollout do not support a single separate prepayment-penalty field for every deferred-deposit transaction; the page instead focuses on the statutory fee, term, aggregate-proceeds and rollover restrictions.
