Amount and term limits

A licensee may hold no more than two checks from one maker at a time, and the aggregate face amount of those checks may not exceed $500. This is a check-face ceiling, so it should not be described as a guaranteed $500 cash advance.

A delayed-deposit licensee may not hold or agree to hold a check for more than 34 days.

Interest, fees and repayment

Nebraska caps the annual percentage rate on a delayed deposit transaction at 36%; a violating transaction is void.

Finance charges, fees, interest and ancillary charges may not be used to exceed the 36% APR ceiling.

The normal transaction is completed by presentment or full redemption of the check. A borrower who cannot repay when due may elect an extended payment plan once in any 12-month period if requested before the due date.

Rollovers, refinancing and early payment

Rollover allowed?
No
Renewal, rollover, deferment or extension is generally prohibited, except for the specific no-additional-fee extension and extended-payment-plan provisions in statute.
Prepayment penalty allowed?
No
An extended payment plan may be prepaid in full at any time without penalty, and the lender may not charge interest or additional fees during the plan.

Nebraska borrower protections

  • APR may not exceed 36%; a violating delayed-deposit transaction is void.
  • Aggregate check face amount with one licensee may not exceed $500 and no more than two checks may be held.
  • Checks may not be held more than 34 days.
  • Rollovers are generally barred.
  • An eligible borrower may use an extended payment plan at no additional cost, with at least four equal payday-aligned payments.

Nebraska loan cost calculator

Why there is no single statutory calculator: The $500 ceiling applies to aggregate check face amount, not necessarily cash advanced, and the 36% APR limit interacts with the actual holding period. A simple fixed-fee payday calculator would be misleading.
